KENYA INTRODUCES NEW COPYRIGHT BILL
Kenya has published the Copyright and Related Rights Bill, 2026, marking the first major overhaul of its copyright regime since 2001. Released by Kenya Copyright Board (KECOBO) for public consultation in March 2026, the Bill aims to establish a modern, digital first framework aligned with the Constitution and international treaties.
Key proposals address ownership and authorship in the digital environment, including AI generated, commissioned and employment created works, while strengthening online enforcement through notice and takedown mechanisms, intermediary safe harbours and enhanced anti piracy remedies.
Institutional reforms include expanded powers for KECOBO, the creation of a specialised copyright tribunal, tighter regulation of collective management organisations, new remuneration rights (such as private copying levies and resale rights), and enhanced protection for performers and neighbouring rights holders.
If enacted, the Bill will have significant implications for rights holders, creators, digital platforms and content driven businesses, necessitating a review of existing contracts, licensing structures and compliance frameworks.
