Prohibited Practices
There are other restrictions that apply to supplier and customer relationships which relate to certain pricing practices; discount or rebate structures or exclusive supply relationships. Lastly, certain conduct is prohibited at the hands of companies that find themselves in a dominant position. In such cases, there is a heightened responsibility on dominant companies not to engage in exclusionary or exploitative conduct.
Our expert competition law team will assist companies in understanding their obligations and to formulate guidelines on what they are allowed to do, as well as potential complaints against the conduct of other companies.
In response to potential prohibited practices, our competition law team can assist with the following aspects:
- Proactively identifying potential prohibited practices
- Assisting companies in responding to allegations of prohibited practices
- Formulating and prosecuting complaints against other companies
- Representing companies in investigations and complaint referrals by the Competition Commission
- Developing training manuals and customised competition compliance programmes
- Reviewing discount and rebate policies
- Advising clients on the lawfulness of existing practices and policies
- Representing companies in ‘whistle blowing’ complaints.
