Kenya proposes major restructuring of its intellectual property system

Kenya is considering a major restructuring of its intellectual property system under the Kenya Intellectual Property Bill, 2026. During a parliamentary hearing on 18 August 2026, the Principal Secretary for Industry highlighted the proposal to consolidate the functions of KIPI, KECOBO and the Anti-Counterfeit Authority under a new Kenya Intellectual Property Authority (KIPA), alongside the establishment of a specialised IP Tribunal. The discussions also considered the implications of artificial intelligence for intellectual property, including ownership of AI-assisted works, as well as the protection of trade marks, geographical indications, traditional knowledge and cultural expressions. If enacted, the Bill would represent a significant restructuring of Kenya’s IP administration and legal framework.
