Nishan has been a partner in the Trade Mark Litigation Section since 2012 and has been the chairperson of the Trade Mark Litigation Department since 2019 to present date. Nishan currently serves as a member of the firm’s Management Committee, which is responsible for the day-to-day management and key decision-making of the firm. He is an admitted attorney of the High Court in South Africa with 12 years of experience in intellectual property law, in particular litigation. Nishan completed his LLB degree summa cum laude in 2005 and thereafter completed his specialisation in intellectual property in 2008, when he qualified as a practitioner of the South African Institute of Intellectual Property Law (SAIIPL). He has served as a Council Member of the SAIIPL and actively participates in the Trade Mark Law committee. Nishan is currently a member of the INTA enforcement committee and the Quick Action Task Force sub-committee.
Nishan specialises in all trade mark, copyright, advertising law, company, business and domain name related disputes throughout Africa. He represents high profile South African and international clients in their trade mark and copyright matters throughout Africa.
Nishan represents his clients in intellectual property litigation matters in the Courts and Trade Mark Registries throughout Africa. As a specialist in this area, Nishan is responsible for the drafting of all intellectual property litigation enforcement actions and appears before the Registry in South Africa to argue trade mark opposition and cancellation matters. Nishan has been responsible for litigation matters that has improved the intellectual property jurisprudence in South Africa, Nigeria, Kenya and OAPI.
Nishan annually attends the INTA annual meeting and has represented the firm in international conferences, such as TMAP and PTMG. Nishan has written numerous articles on a wide range of IP related topics in South Africa and published articles in newsletters and local publications. He has also presented talks on IP on international platforms such as MONDAQ and at many South African conferences. Nishan has been quoted in newspaper articles and is regularly interviewed on radio as a specialist in intellectual property law.
