Who may apply for a patent?
A patent application can be filed in the name of an individual, such as the inventor, or a legal entity, such as a company.

It can also be filed in the name of an assignee. An assignee is a natural person or a company who has obtained a written assignment of rights for the invention from the inventor.

There can be more than one inventor or assignee named as the applicant. Where are there joint applicants, it is advisable that they enter into a written agreement to define their rights and obligations. Without an agreement, the joint applicants have equal undivided shares in the patent.

Is my patent valid in all countries or must I apply for a patent in individual countries?
It is a common misconception that you can have a worldwide patent. In fact, you need to obtain protection in each country or territory where you require it.

This is achieved by filing a separate patent application in each country or territory of interest.

In terms of the Paris Convention, if you file a first application in South Africa, you can claim the priority of this filing date for a corresponding application filed within 12 months in another convention country.

If you are considering patent protection in several countries, you can follow the PCT application route and at the required time, file national phase applications in each desired country.

Each country or territory will then examine the application until it proceeds to grant.
